Breaking: Supreme Court Accepts Case Challenging Jan. 6 Obstruction Charges
Friends, let’s discuss the breaking news from the Supreme Court, which decided yesterday to hear this federal lawsuit.
“The U.S. Supreme Court will take up a Jan. 6 defendant’s appeal of the Department of Justice’s novel use of evidence-tampering law to prosecute hundreds of defendants for obstruction of Congress.
A miscellaneous order released by the high court on Dec. 13 granted the petition of Joseph Wayne Fischer, challenging the most widely charged felony in Jan. 6 cases, which carries up to 20 years in prison.”
Along with hundreds of other defendants, the DOJ also brought these obstruction charges against Trump.
Here’s the question in dispute: Did the D.C. Circuit err in construing 18 U.S.C. § 1512(c) (“Witness, Victim, or Informant Tampering”), which prohibits obstruction of congressional inquiries and investigations, to include acts unrelated to investigations and evidence?
The federal government has applied an evidence-tampering law, originally intended to prevent evidence destruction in white-collar crimes, to punish individuals who were at the Capitol on January 6th.
Hundreds of people have been convicted under 18 U.S. § 1512 one of them being Alan Hostetter, a freedom fighter from Orange County, California.
I hardly ever touch politics, but I do cover current events and a number of significant Supreme Court cases. One of the DOJ-convicted defendants is an Orange County resident who has been on the frontlines fighting for freedom since the covid hogwash began. He was recently sentenced to 11 years in prison for his role in the incident at the Capitol.
I admit that I haven't been paying close attention to the January 6th news. Many individuals from Orange County attended, and as far as I know, there is no crime in attending a political rally, but events took a certain turn... and I'll let you form your own conclusions based on what you've learned and observed.
Having said that, because this hits close to home, I feel compelled to continue covering this story.
This news is promising for many defendants because there would have been no need to take the case further if the justices of the Supreme Court who chose to hear it had agreed with the appellate court's ruling.
Several defendants have already asked for their sentencing to be suspended until the Supreme Court resolves this obstruction case.
I expand on the importance of this appeal plus details about Alan and his sentencing in my video below. Here’s the press release from the DOJ.
In conclusion, this decision by the Supreme Court to accept the case holds considerable weight, indicating a willingness among several justices to delve deeper into the matter. It will impact numerous defendants, including Trump and those who have already sought a suspension of their sentencing until the court resolves the obstruction case.

Was anyone ever prosacuted for the FBI CIA police stand down, encouraged BLM's etc. fire bombing, "peaceful protests."???
I remember seeing him speak on videos back in 2020, as I shared so many videos on social media of people standing up for truth. I also did see him in person down in OC at the Board of Supervisors meetings when they were trying to implement their V passport. A good man speaking up for freedom and truth. I think a man from Fresno, may have also been arrested, Benjamin Martin, from facebook, I had seen him standing up against the mask bs and mandates there.
