DID TEXAS JUST DECLARE WAR on the FEDS?
Gov. Abbott defends the state against an invasion of illegal immigrants
Some of you are like me and have come from a family of immigrants.
Legal immigrants.
Immigrants who came to this country to MAKE a better life for themselves — not to be given gift cards, housing, food, medicine and transportation paid for by we the tax payers.
I have a great deal of compassion for individuals facing adversity in countries plagued by unfortunate circumstances. Throughout my career, I've dedicated significant time to teaching immigrants in ESL programs. While my compassion for those in distress is unwavering, I have a profound respect for the law.
When it comes to this massive wave of illegals entering the U.S., I wonder about their background. Were they let out of prison and told to come here? Are they connected to drug cartels or human trafficking networks?
And is there a chance they might be waiting for orders to start armed protests?
We need to think about these things because I believe the end game is the destruction of America.
I covered what I think might really be going on in my previous video below:
As the tension grows between states and the federal government over the border, we must consider whether they are deliberately creating a constitutional crisis to divide our nation further.
What would it look like if there was a civil war? If a civil war were to happen, the consequences would likely be devastating, causing widespread destruction, loss of life, and a significant impact on the nation's stability and unity.
If you missed the news, the Supreme Court surprisingly backed the Biden Admin in the dispute with Texas over the border barrier.
In a three-sentence, 5-4 order that left everyone scratching their heads, the Supreme Court overturned a Texas federal court injunction, allowing Biden's Border Patrol to dismantle Texas's carefully-installed anti-immigrant razor wire, but only in medical emergencies. Why? Well, nobody knows, and the Court didn't feel the need to explain.
This time, Justices Thomas, Alito, Gorsuch, and Kavanaugh favored keeping the razor-wire injunction, while Roberts and Barrett, along with the liberal trio, backed the feds.
Note: The 5th U.S. Circuit Court of Appeals' prior injunction, which had stopped Border Patrol agents from cutting the concertina wire, was overturned by the Supreme Court's 5-4 order. This wasn’t a final ruling on the case.
Yes, it’s true, the U.S. Constitution grants the federal government the power to regulate immigration and control the nation's borders AND the Supremacy Clause of the Constitution (Article VI, Clause 2) establishes that federal law is the supreme law of the land. This means that federal immigration laws supersede conflicting state laws.
And it’s also true that the federal government, particularly through agencies like U.S. Customs and Border Protection (CBP) and the Department of Homeland Security (DHS), is responsible for protecting and securing the U.S. borders.
…but here’s the thing: The federal government has failed to fulfill their constitutional duties to enforce these laws and protect and secure the U.S. borders.
The Executive branch is supposed to be the enforcer of our nation’s laws, but rather than zealously enforcing established laws and securing its own borders, the Biden Administration has been far more preoccupied with securing other country’s borders.
What does Texas do in response? It doesn't back down; in fact, Texas doubles down on its border invasion declaration.
Governor Abbott’s statement on Texas’ constitutional right to self-defense
What the Constitution says:
State Self-Defense Clause: Article I § 10, Clause 3
No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.
The Invasion Clause: Article IV § 4
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
So basically Texas is claiming that the federal government's failure to protect it from outside threats constitutes a violation of the Invasion clause. Therefore, this triggers the sovereign right of Texas to defend itself.
So what constitutes “actually invaded” for purposes of Article I, Section 10 (“State Self-Defense Clause”) and “invasion” for purposes of Article IV, Section 4 (“Invasion Clause”) of the U.S. Constitution? Do States retain constitutional power to defend themselves when “actually invaded” by hostile non-state actors such as armed cartels and gangs, or only by foreign powers?
For a comprehensive analysis of this important question, Re: The Federal Government’s Duty To Protect the States And The States’ Sovereign Power Of Self Defense When Invaded, read the Arizona Attorney General’s opinion here.
“Ordinarily courts do not construe words used in the Constitution so as to give them a meaning more narrow than one which they had in the common parlance of the times in which the Constitution was written.” United States v. S.-E. Underwriters Ass’n, 322 U.S. 533, 539 (1944), superseded by statute on other grounds. Moreover, as Chief Justice Marshall famously stated, “we must never forget that it is a constitution we are expounding.” McCulloch v. Maryland, 17 U.S. 316, 407 (1819).
Red State Governors Announce They Stand with Texas
States in red are those (currently) standing with Texas. The Texas stand-off is developing quickly, so some of these details are still emerging.
Whispers of civil war preparations continue to gain momentum and politicians have added fuel to the fire, sparking speculations about the potential for a significant upheaval.
Others have highlighted parallels between longtime WEFer Abbott's declaration with American Civil War era rhetoric.
Is this secession psy-op orchestrated by both sides to start a constitutional crisis? Will it usher in martial law? Lead to a gun grab? Accelerate the destruction of our country? What’s the endgame?
